Welcome to Hawa Canada. These Terms of Service (“Terms”) govern your use of our website
and services. By accessing or using our services, you agree to be bound by these Terms. If you
do not agree to these Terms, please do not use our services.
1. Acceptance of Terms
By using our services, you agree to comply with and be legally bound by these Terms and all
applicable laws and regulations. If you do not agree to these Terms, you must not use our
services.
2. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by
posting the new Terms on our website. Your continued use of our services after any such
changes constitutes your acceptance of the new Terms.
3. Eligibility
You must be at least 18 years old to use our services. By using our services, you represent and
warrant that you meet this age requirement.
4. Account Registration
To access certain features of our services, you may be required to create an account. You
agree to provide accurate, current, and complete information during the registration process
and to update such information to keep it accurate, current, and complete. You are
responsible for safeguarding your password and for all activities that occur under your
account.
5. Services
Hawa Canada offers a variety of event planning services, including but not limited to planning
community events, internal all-hands, conferences, charity dinners, sponsor, and selling
tickets. Our services are intended for use by individuals and businesses who are organizing
events.
6. Use of Services
You agree to use our services only for lawful purposes and in accordance with these Terms.
You agree not to:
- Use our services to impersonate or attempt to impersonate Hawa Canada, a Hawa
Canada employee, another user, or any other person or entity. - Use our services in any way that violates any applicable federal, provincial, local, or
international law or regulation. - Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of our
services, or which, as determined by us, may harm Hawa Canada or users of our
services.
7. Event Planning and Sharing
By using our event planning and sharing services, you agree to:
- Comply with all applicable laws and regulations related to your event.
- Provide accurate and complete information about your event.
- Obtain all necessary permissions and consents to share your event information on
social media and with the local community.
8. Payment and Refunds
- All payments for our services are processed securely by our payment partners, Stripe.
You agree to pay all fees and charges associated with your use of our services. By
making a payment, you agree to our refund policy and the terms and conditions of
Stripe. - We will issue a refund for any payments made for services that are not provided.
Refunds will be processed through Stripe and may take several days to complete.
9. Cancellations
You may cancel your booking at any time before the event. Cancellations made more than 30
days before the event will be fully refunded. Cancellations made less than 30 days before the
event will not be refunded.
10.Intellectual Property
All content, features, and functionality of our services, including but not limited to text,
graphics, logos, and software, are the exclusive property of Hawa Canada and are protected
by Canadian and international copyright, trademark, patent, trade secret, and other
intellectual property or proprietary rights laws.
11. Limitation of Liability
To the fullest extent permitted by law, Hawa Canada, its affiliates, and their respective
directors, officers, employees, agents, service providers, and licensors shall not be liable for
any indirect, incidental, special, consequential, or punitive damages, including but not
limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use of or inability to use our services.
- Any conduct or content of any third party on our services.
- Any content obtained from our services.
- Unauthorized access, use, or alteration of your transmissions or content.
13.Governing Law
These Terms and your use of our services shall be governed by and construed in accordance
with the laws of the Province of Ontario and the federal laws of Canada applicable therein,
without regard to its conflict of law principles.
14.Dispute Resolution
Any disputes arising out of or relating to these Terms or our services shall be resolved through
binding arbitration in accordance with the Arbitration Act, 1991 (Ontario). The arbitration shall
be conducted in Toronto, Ontario, in the English language.
15. Termination
We reserve the right to terminate or suspend your account and access to our services, without
prior notice or liability, for any reason, including if you breach these Terms. Upon termination,
your right to use our services will immediately cease.
